Booking Terms and Conditions

  1. These terms
    • These are the terms and conditions (the “Terms”) which apply when you purchase a Hospitality Package or book an Event (as defined below) via our website https://amber-lounge.com/(“Website”).
    • Please read these Terms carefully before you submit your Order (as defined below) to us as they provide important information about the order process, payment terms and other issues. In some instances, there are additional terms which will apply depending on whether you are a business customer or an individual customer, so please ensure you understand the sections which are relevant to you.
    • Our Privacy Notice is deemed to be incorporated into these Terms and should be read in conjunction with this document.
  2. Information about us and how to contact us
    • We are Amber Lounge Pte. Ltd. (“Amber Lounge”) is a company registered in Singapore, and our registered office is at 3 Raffles Place 06-01 Bharat Building, Singapore 048617.
    • You can contact us by writing to us at the address above or by email at the address supplied on our website, or by telephoning us at the number displayed on our website.
    • If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your Order. For information about how we process Personal Data as part of your Order please refer to the Privacy Notice.
  3. Definitions and interpretation
    • In these Terms, the words and expressions set out below shall, unless the context otherwise requires, have the following meanings:

Event                                       means parties, fashion shows, charitable events and other events which are displayed on the Website, including any events which are offered as part of a Hospitality Package.

Fee                                            means the price of the relevant Event or Hospitality Package paid or payable by you to Amber Lounge, as detailed on the Website at the time of order.

Force Majeure Event                means any event or circumstances beyond the reasonable control of a party (including, without limitation, industrial or civil disputes war, governmental action, riot, fire, flood, drought, other natural disaster or act of God, riot, crowd disorder, civil commotion, military operations, explosion, structural damage, terrorism (including the threat of terrorism) and epidemics, shortage of power supplies, strike, lock-out, boycotts or other industrial action of the affected party of their sub-contractors, delay, interruption, rescheduling, postponement or cancellation of the Event.

Guest                                       means any guest benefiting from a Hospitality Package or Event that you have booked.

Hospitality Package                 means Grand Prix weekend experiences, race viewings, lifestyle events, celebrity yacht hospitality events, luxury accommodation and transfers, and any other hospitality packages which are advertised on the Website.

Location                                    means the venue, area or premises at which an Event or Hospitality Package is held.

Order                                        means an order which you place on our Website for an Event or Hospitality Package.

Passes                                     means passes and any other documents or materials supplied by Amber Lounge relating to an Event or Hospitality Package.

Personal Data                          means information about a living individual who can be identified from that data (either by itself or when it is combined with other information).

Prohibited Materials                means:

(a) banners or other signs bearing offensive or provocative images, messages or slogans;

(b) promotional and commercial objects and materials of whatever nature, including but not limited to documents, leaflets, badges, signs, symbols, banners and clothing;

(c) any promotional or commercial items of whatever nature that incorporate logos, branding, get-up or other slogans associated with you or any of your Guests; and

(d) any other objects or materials identified by Amber Lounge that may affect Amber Lounge’s reputation, the Event or the Hospitality Package.  

  1. Orders
    • The Website advertises Events and Hospitality Packages and gives information about them. By advertising Events and Hospitality Packages on the Website, we are inviting you to place an Order. If you place an Order, a contract will only be formed with us if we accept that Order. Our acceptance will take place once you have paid the Fee to us in accordance with clause 6 and we have emailed you confirming the Order.
    • We may refuse an Order in certain circumstances, for example if:
      • we are unable to obtain authorised payment or the payment process is incomplete; or
      • we identify an error on the Website; or
      • we suspect that the Order is related to fraudulent activity; or
      • you fail to submit all necessary and relevant details to allow us to fulfil the Order; or
      • the Event(s) and / or Hospitality Package(s) ordered are unavailable or fully booked.
    • If we refuse to accept an Order we will inform you of this and, if applicable, we will refund you for the Event or Hospitality Package ordered.
  2. Cancellation rights if you are an individual customer
    • Please note that there is a strict cancellation policy and all hospitality tickets are subject to a 100% cancellation penalty of any deposits or payments made with the exception of clauses 5.2 and 5.3 below.
    • For any Amber Lounge Club product, if you cancel this contract 90 days or more before the date of an Event, you shall be liable to pay a minimum of 50% of the total Fee.
    • For any Amber Lounge Club product, if you cancel this contract less than 90 days before the date of an Event, you shall be liable to pay us for the total Fee.
  3. Price and Payment
    • The Fee will be the price indicated on the Website when you place the Order. Whilst we try to ensure that all prices on the Website are accurate, errors may occur. If we discover an error in the Fee on the Website we will inform you as soon as possible and give you the option of reconfirming your Order at the correct Fee or cancelling the Order. If we are unable to contact you, you agree that we may treat the Order as cancelled.
    • All sums due by you to us shall be paid in the currency indicated on the Website along with any applicable taxes, duties, charges or levies specified.
    • All credit and charge card holders are subject to validation and security checks as well as authorisation by the card issuer and any additional terms imposed by the issuer. If the issuer does not authorise payment, we will not accept the Order and will not be liable for any delay or non-delivery.
  4. Collection of Passes
    • Your Passes will be available for collection from our office four days before the relevant Event or Hospitality Package that you have booked. Under no circumstances passes will be send by post.
  5. No sponsorship rights
    • You expressly acknowledge and agree that the purchase of Hospitality Packages or Events does not grant you or any Guest any marketing or promotional rights with respect to us, the Hospitality Packages, Events, or any of our commercial partners or stakeholders.
    • You shall not, and you shall procure that each of your Guests shall not, hold yourselves out as a sponsor of, use any intellectual property connected with or otherwise associate yourselves in any manner whatsoever with the Hospitality Packages, Events or any of our commercial partners or stakeholders.
    • You shall not, and you shall procure that your Guests shall not:
      • use the Events or Hospitality Packages for marketing or promotional purposes (including but not limited to use as a prize in competitions, lotteries, draws, charity promotions or sweepstakes); or
      • conduct any promotional, advertising or marketing activity in connection with Amber Lounge, the Hospitality Package, Event or any of our commercial partners or stakeholders.
    • You agree that neither you nor your Guests shall have any right to promote yourselves or your businesses in any Location or otherwise associate yourselves with us, the Hospitality Package, Event or any of our commercial partners or stakeholders, unless expressly authorised by us in writing.
  6. Access to Location
    • You acknowledge that access to a Location is strictly limited to the date and the time indicated on your Passes relating to the Hospitality Package or Event that you have booked.
    • We reserve the right to substitute or amend the details of an Event or Hospitality Package (including but not limited to any seats, areas or services initially allocated to you) if such amendment is required:
      • in order to comply with local applicable laws in force during the Hospitality Package or Event; or
      • due to security constraints or other reasons in connection with the staging of the Event or our provision of the Hospitality Packages, in which case, we shall use all reasonable efforts to provide you with an event or hospitality package which is (in our opinion) as similar as possible to the Event or Hospitality Package that you have booked. In such circumstances, we shall notify you of the details of the new event or hospitality package.
  1. Your conduct at Events
    • You shall, and you shall procure that your Guests shall, at all times comply with all directions and instructions of the competent authorities at all of the Locations.
    • You shall use your best endeavours to ensure that your Guests comply with all rules and safety regulations established at each Location and acknowledge that if you and / or your Guests are disruptive to the Hospitality Package, Event or the enjoyment, comfort or safety of other attendees, then you and / or your Guest may be refused admission.
    • You shall not, and you shall procure that your Guests shall not, bring, use or display any Prohibited Materials to or at an Event or Hospitality Package.
    • Any breach of these Terms may result in the suspension of your ability to attend the relevant Event or Hospitality Package purchased by you.
    • If you or your Guests breach this clause 10, you and / or the Guest (as applicable) shall have no right to a refund from us and we shall not have any liability whatsoever to you or the Guest.
  2. Passes
    • You acknowledge that Passes that are damaged may not be accepted for admission to the Location.
    • We shall not replace or reimburse you in respect of any lost, stolen, damaged, destroyed or defaced Passes, unless where this occurs as a result of our negligent act or omission.
    • You warrant that you are purchasing the Events and / or Hospitality Packages for use by you and your Guests only. You shall not be entitled to resell, exchange or make available to any other person the Passes or any other element of the Events or Hospitality Packages.
    • You shall not, and you shall procure that your Guests shall not, use the Passes as competition prizes or trade incentives or in raffles, lotteries or draws whether for commercial or charitable purposes.
  3. Rescheduled or Cancelled Events and Hospitality Packages
    • You are advised to take out insurance to cover the risk and costs associated with a delay, interruption, rescheduling or postponed or cancelled Hospitality Package or Event.
    • The times, dates and places of the Event, Hospitality Package or any part thereof may be modified without notice to you as a result of a Force Majeure Event, including (but not limited to) act of God, war, terrorist activity, strike, lock-out, industrial action, political insurgence, fire, flood, drought, tempest or any other natural or man-made eventuality, pandemic, mechanical or technical breakdowns or suspension or cancellation of an event by the third parties. Should this arise, we will use our best efforts to re-arrange that Hospitality Package or Event. If we are able to provide a substantially similar Hospitality Package or Event, then your booking for the relevant Hospitality Package or Event shall remain valid for the rescheduled or relocated Hospitality Package or Event, this with a possible costs to you for part of our costs inevitable to this reallocation , and you shall not be entitled to claim any refund and we shall have no liability whatsoever to you or any Guest as a result. If we are unable to provide a substantially similar Hospitality Package or Event, you will be entitled to cancel your booking and claim a refund, save that we shall be entitled to retain any booking or administrative costs reasonably incurred by us prior to the date of cancellation.
    • If the Event, Hospitality Package or any part thereof is cancelled as a result of Force Majeure Event and is not rescheduled, then fees will be returnable with a possible small fee for irretrievable costs and management time if occurred.
    • In the event that we cannot deliver the Hospitality package or Event under the contract and not caused by any of clause 12.2’s events, our liability shall be limited to the amount of the price paid by the Client for such booking and shall not extend to any consequential loss or damage suffered and our liability under this condition
  4. Liability
    • You shall be responsible for notifying each Guest of these Terms, and you shall procure the full compliance of your Guests with them.
    • We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors or for fraud or fraudulent misrepresentation.
    • You shall be responsible for all damage caused by you and / or your Guests.
    • You agree that the personal arrangements of you and your Guests in connection with the Events and / or Hospitality Packages (including, without limitation, travel and accommodation) are entered into by yourself and your Guests at your own risk and that we shall not be liable for any costs, losses, loss of enjoyment or wasted expenditure (including, without limitation, any indirect and / or consequential loss or damage) suffered by you or your Guests.
    • In addition to clauses 13.1 – 13.3, if you are a business customer:
      • Other than the specific remedies expressly referred to in these Terms, we shall not be liable to you or any Guest for any consequential loss or damage, any loss of profit (whether direct or indirect) or business or loss of future business or loss of enjoyment or otherwise, or any other costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the supply of Events or Hospitality Packages or your use or attendance of them.
      • All warranties, conditions or other terms implied by statute, common law or otherwise are excluded to the fullest extent permitted by law.
      • Subject to clause 13.1, our total liability to you and your Guests whether for negligence, breach of contract, misrepresentation or otherwise shall in no circumstance exceed the Fee paid in respect of the Hospitality Package and / or Event to which your claim relates.
      • You shall indemnify and hold us harmless from and against all claims, costs, losses, damages, expenses, demands and liabilities suffered or incurred by us as a result of a breach by you or your Guests of these Terms or in connection with, resulting from, or arising out of any and all acts or omissions of you or your Guests.
    • In addition to clauses 13.1 – 13.3, if you are an individual customer:
      • We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
  1. How we may use your Personal Data
    • We will only use your Personal Data as set out in our Privacy Policy.
  2. Other important terms
    • We may transfer our rights and obligations under these Terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under these Terms. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.
    • Subject to clause 15.1, this contract is between you and us. No other person shall have any rights to enforce any of its terms.
    • Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
    • If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
    • These terms are governed by Jersey law and you can bring legal proceedings in respect of the products in the Jersey courts.
    • These Terms constitute the entire agreement between you and Amber Lounge, and supersede any previous agreement or understanding and may not be varied except as expressly agreed in writing by an authorised officer of Amber Lounge. All other terms, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.
